These Terms of Use govern access to and use of smarterme.ca, operated by SmarterMe Mental Health Services through Maria Slutski in Ontario, Canada. By using this website, you agree to these Terms. If you do not agree, do not use the website.

1. Informational purpose only

The website provides general information about mental health services and consultation coordination. Website content does not constitute medical, psychiatric, psychotherapy, nursing, legal, or other professional advice and must not be used as a substitute for an individualized assessment by a qualified professional.

Using this website, submitting a form, or sending an email does not create a clinician–patient, therapist–client, nurse–patient, or other professional relationship. A professional relationship begins only after acceptance, informed consent, and completion of the applicable intake or service agreement.

2. Not an emergency or crisis service

This website and its email channels are not monitored continuously. Do not use them for emergencies or urgent medical concerns. Call 911 or attend the nearest emergency department when immediate assistance is required.

3. Independent regulated professionals

Services promoted or coordinated through SmarterMe Mental Health Services may be delivered by independent regulated professionals or clinical partners. Each professional remains responsible for their own clinical judgment, scope of practice, informed-consent process, documentation, professional obligations, and regulatory compliance.

4. Eligibility and availability

Services are subject to clinical suitability, professional availability, jurisdictional restrictions, and completion of required intake procedures. Submission of a consultation request does not guarantee acceptance, an appointment, medication, diagnosis, treatment, or any particular outcome.

5. Fees, payment, and cancellation

Fees and payment terms are confirmed before a service is provided. Cancellation, rescheduling, late-arrival, form-completion, report, prescription, and administrative fees may apply as communicated during booking or intake.

6. Prescribing and medication

Any prescribing decision is made solely by an authorized prescriber following an appropriate assessment and in accordance with applicable law, professional standards, and clinical judgment. No medication or prescription is guaranteed through use of this website.

7. Third-party services

The website may link to scheduling, payment, video, pharmacy, laboratory, email, or other third-party systems. Use of those systems is governed by their own terms and privacy policies. SmarterMe Mental Health Services is not responsible for third-party availability, security, content, or acts and omissions.

8. Intellectual property

Unless otherwise stated, the website’s text, design, layout, graphics, branding, and other content are owned by SmarterMe Mental Health Services or used with permission. You may not reproduce, distribute, modify, or commercially exploit website content without prior written permission.

9. Acceptable use

You must not use the website unlawfully, attempt unauthorized access, introduce malicious code, interfere with website operation, impersonate another person, submit false information, or scrape or collect information by automated means without permission.

10. Disclaimer

The website is provided on an “as is” and “as available” basis. To the extent permitted by law, no warranty is made regarding uninterrupted availability, completeness, accuracy, suitability, or freedom from technical errors.

11. Limitation of liability

To the fullest extent permitted by law, SmarterMe Mental Health Services and Maria Slutski will not be liable for losses arising from reliance on general website content, inability to access the website, third-party services, or unauthorized use of the website. Nothing in these Terms excludes liability that cannot lawfully be excluded.

12. Governing law

These Terms are governed by the laws of Ontario and the applicable federal laws of Canada. Any dispute will be subject to the courts of Ontario, unless applicable law requires otherwise.

13. Changes and severability

These Terms may be updated from time to time. If any provision is found unenforceable, the remaining provisions continue in effect.
